This Disclaimer applies to the Ashkon Software L.L.C. (“Ashkon Software”, “we”, “us”) web site www.ashkon.com, to all software published by Ashkon Software (trial, free and registered versions, wherever downloaded), and to any data, documentation, support or other content we provide (together, the “Software and Content”). By using the web site, or by downloading, installing or using the Software, you accept this Disclaimer. If you do not accept it, do not use the Software and Content.

1. Information only – not professional advice

Data and information provided on this site or through our Software, including stock quotes, charts, technical indicators, trading signals, backtesting results, predictions, sector and index lists, news, currency rates and tax estimates, are provided for informational and educational purposes only. They are not intended for trading purposes and do not constitute investment, financial, trading, tax, accounting or legal advice, or a recommendation to buy, sell or hold any security or other financial instrument.

Trading and investing involve substantial risk of loss. Past performance, historical data and backtested or simulated results do not guarantee future results. You are solely responsible for your own investment and financial decisions and should consult a qualified professional before making them. Neither Ashkon Software nor any of its data or content providers shall be liable for any errors, omissions, inaccuracies or delays in the content, or for any actions taken in reliance on it.

2. Third-party data and services

Some Software retrieves data from, or works with, services operated by third parties (for example our market data provider EODHD, news providers, Google, Microsoft and other email or online service providers). Ashkon Software does not control these services and makes no representations about their accuracy, completeness, timeliness or availability. Third parties may change, limit, suspend or discontinue their services, interfaces, terms or access rules at any time, which may cause features of the Software to stop working, in whole or in part. Your use of a third-party service is governed by that third party’s terms, and you are responsible for complying with them. Ashkon Software is not responsible for any action a third party takes with respect to your account, including rate limits, suspension or loss of data.

In particular, Advanced Email Migrator connects to Gmail and Google Workspace over IMAP with a Google app password that you create and manage in your own Google Account. It is not a Google-verified application and is not affiliated with or endorsed by Google or Microsoft. Its Gmail features depend on Google continuing to offer IMAP access and app passwords, which Google or your Google Workspace administrator may restrict or turn off at any time. Gmail limits how much mail can be uploaded or downloaded over IMAP per day (about 500 MB and 2,500 MB at the time of writing) and may temporarily block IMAP access to an account that exceeds these limits. You are responsible for keeping your app password confidential and for revoking it when you no longer use the Software.

3. Market data provided by EODHD

Unless stated otherwise, stock quotes, historical prices, fundamentals and other market data shown on this site and used by our Software are provided by EODHD (EOD Historical Data). Some of our products instead download freely available data from public sources on the internet; where this is the case, it is stated in the product’s description or documentation, and that data is subject to the terms of its source.

Ashkon Software does not create, verify or guarantee any market data, whatever its source. Market data may be delayed, incomplete, adjusted or corrected after publication, and is subject to the terms of its provider and to the rules of the exchanges and other sources it comes from. Ashkon Software, EODHD and other data sources are not liable for any errors, omissions or delays in the data or for any decisions made on the basis of it. Market data is provided for your personal, informational use only and may not be redistributed or resold.

4. No warranties

The Software and Content are provided “as is” and “as available”, with all faults and without warranties of any kind, express, implied or statutory. To the fullest extent permitted by law, Ashkon Software disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment and any warranties arising from course of dealing or usage of trade.

Ashkon Software does not warrant that the Software will meet your requirements, operate without interruption or error, be compatible with your hardware, operating system or other software, be free of defects, viruses or other harmful components, or that defects will be corrected. No oral or written information or advice given by Ashkon Software or its representatives creates any warranty.

By downloading and running the Software from this or any other site distributing it, you assume all risk with respect to the Software and acknowledge that it may have defects or deficiencies, and that certain features and functions may change, may not be included in subsequent releases or may not be available at all times.

5. Your responsibilities: backups and use at your own risk

Several of our programs perform operations that change your computer, your files or your online accounts, and some of these operations cannot be undone. Examples include permanently erasing files (Advanced File Shredder), changing startup entries, ending processes or restarting the computer (Simple Startup Manager, Advanced Process Explorer, RebootEx), blocking web sites or network access (Website Block), and copying, labeling or organizing email in your mailbox (Advanced Email Migrator). You are solely responsible for:

  • making and verifying complete backups of your data, files, email and system before using the Software;
  • reading the documentation and confirming each operation before you start it;
  • checking the results, including that migrated or converted email, folders and attachments are complete and correct before you delete or stop using the original source;
  • having the right to access, copy and process the files, mailboxes, accounts and computers you use the Software with;
  • complying with all laws, regulations and third-party terms that apply to your use of the Software.

Ashkon Software is not responsible for any loss, corruption, duplication or disclosure of data, files or email, for system instability or downtime, or for any other consequence of operations you perform with the Software.

6. Limitation of liability

To the fullest extent permitted by law, in no event shall Ashkon Software L.L.C., its owners, officers, employees, contractors, distributors or data and content providers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, trading or investment losses, loss of data, email or files, loss of goodwill, business interruption, cost of substitute goods or services, or computer failure or malfunction, arising out of or related to the Software and Content or the use of or inability to use them, however caused and under any theory of liability (contract, tort including negligence, strict liability or otherwise), even if Ashkon Software has been advised of the possibility of such damages.

Ashkon Software’s total cumulative liability for all claims arising out of or related to the Software and Content shall not exceed the amount you actually paid to Ashkon Software for the license of the Software giving rise to the claim during the twelve (12) months before the claim arose, or US$10 if you paid nothing.

These limitations apply even if any limited remedy fails of its essential purpose, and they are an essential basis of the bargain between you and Ashkon Software; the Software would not be offered, or would be offered at a substantially higher price, without them.

7. Indemnification

You agree to defend, indemnify and hold harmless Ashkon Software L.L.C. and its owners, officers, employees and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your use or misuse of the Software and Content, your violation of this Disclaimer or of any law or third-party right or terms, or any data or content you process with the Software.

8. No high-risk use

The Software is not designed, intended or licensed for use in hazardous environments requiring fail-safe performance, or in any system where a failure or inaccuracy could lead to death, personal injury, or severe physical, property, environmental or financial damage. You may not use the Software for such purposes.

9. Trial, free and discontinued versions

Trial, free and evaluation versions are provided so you can confirm that the Software fits your needs before purchase; this Disclaimer applies to them in full. Ashkon Software may change, update or discontinue any product, feature, web page or support at any time without notice and without liability. Discontinued products are provided, if at all, without support or updates.

10. Web site content and links

Content on this web site may contain errors or be out of date, and may be changed at any time without notice. Links to third-party web sites are provided for convenience only; Ashkon Software does not endorse and is not responsible for their content, products, services or privacy practices.

11. Applicable law and severability

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions some of the exclusions and limitations above may not apply to you, and Ashkon Software’s liability is limited to the fullest extent permitted by applicable law. Nothing in this Disclaimer limits any rights you have as a consumer that cannot be limited by contract. If any provision of this Disclaimer is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

This Disclaimer is governed by the laws of the state in which Ashkon Software L.L.C. is organized and the federal laws of the United States, without regard to conflict-of-law principles. Where a separate license agreement accompanies a product, that agreement also applies; if the two conflict, the provision that gives Ashkon Software the greater protection applies to the extent permitted by law.
